The War in Gaza has drawn Israel into international controversy like no other. We explain how and why Israel has been brought before various “courts of the world,” particularly in the United Nations and its legal institutions. We explore how “lawfare” has been turned against Israel in the UN, the International Court of Justice (ICJ), and the International Criminal Court (ICC). Are these actions due to fair legal calls, an adverse balance of power, or plain anti-Semitism? These actions are unprecedented and bound to affect Israel’s right of self-defense, yet are largely unenforceable against non-state actors like Hamas and Hezbollah. Non-state actors shield themselves behind civilians, while legitimate states are constrained by the “laws of war.” Is it time to update international rules to reflect current conflicts?
